Eligibility Requirements for EB-3 Visa

To be eligible for an EB-3 visa, you must meet the following requirements:

  • Have a valid job offer from a U.S. employer
  • Possess the required skills and qualifications for the job
  • The job offered must not be able to be filled by a qualified U.S. worker

There are three subcategories under which you can apply for an EB-3 visa: 

  • Skilled workers: Those with at least two years of experience or training. A relevant post-secondary degree may serve as a substitute for experience.
  • Professionals: Those who have a U.S. baccalaureate degree or its foreign equivalent.
  • Other workers: Those who are capable of performing “unskilled labor.” This generally includes labor that requires fewer than two years of training to complete.

Application Process for EB-3 Visa

The application process for an EB-3 visa includes the following steps:

  1. The U.S. employer must file a Form I-140, Petition for Alien Worker, on behalf of the foreign national worker.
  2. Once the petition is approved, the worker may apply for an immigrant visa or adjust their status to that of a permanent resident.
  3. For applicants outside of the U.S., consular processing is necessary. They must also attend an interview at a U.S. embassy or consulate.
  4. If applying from within the U.S., the applicant must submit Form I-485, Application to Register Permanent Residence or Adjust Status, and participate in an interview at a U.S.C.I.S. office.
